27/07/2010 - EBAA WELCOMES ELIMINATION OF COMPLEX US TSA INTERNATIONAL WAIVER REQUIREMENTS
The European Business Aviation Association (EBAA) welcomes the announcement by US Department of Homeland Security Secretary Janet Napolitano that US-bound international operators will now benefit from a simplified procedure for in-bound flights to the United States, signalling the end of the current, onerous TSA International Waiver process.

The EBAA, in concert with the National Business Aviation Association, has been in discussions with US government officials over the past five years in order to introduce a modified waiver procedure that would ease the high administrative burden of filing for flights to the US, while still safeguarding the integrity of US security policy.

The new simplified procedure is based on the web-based Electronic Advance Passenger Information System (e-APIS) overseen by US Customs and Border Protection (CBP). Under this system, each time an operator sends data through the eAPIS, the CBP will forward a copy to the TSA providing them with the required information. For its part, the undemanding eAPIS system, which collects electronic traveller manifest information for international travel both in to and out of the United States, has been widely received by the aviation community since its introduction a few months ago.

This new process will streamline the process for pre-screening passengers and crew for all Business Aviation commercial and non-commercial foreign operations by allowing pilots and operators to submit a single manifest to the e-APIS as from 1 September this year. The greatest advantage compared to the waiver system is that operators will get almost an instant response from the system.

30/03/2010 - EASA RELEASES A NPA ON THE NEW VERSION OF ACAS II
EASA has published a Notice of Proposed Amendment (NPA) on the introduction of ACAS II software version 7.1 on its website. EASA invites any stakeholder wishing to send any comment to place them on the Agency’s website indicated below. This NPA will be open for consultation until 7th May 2010. The NPA states that the mandate will enter into force on 1st March 2012 for new aircraft and on 1st March 2014 for retrofit aircraft.

02/03/2010 - EUROPEAN COMMISSION PUBLISHES NEW PRIOR COMPLIANCE LIST FOR DIRECTIVE 2003/87/EC ON ETS
A prior compliance list (updated on 26.02.2010) has been established for aircraft operators that are currently outside the scope of the scheme, but forecast that they will be covered by Directive 2003/87/EC in 2010. They may be outside of the scope of the scheme for reasons such as they are currently under the 'de-minimis' exemption or have started, or plan to start aviation activities in 2009 or 2010. The purpose of the prior compliance list is to allocate these operators to an administering Member State to enable them to participate in the tonne-km and emissions monitoring in 2010.

It is possible that further aircraft operators will request such a preliminary allocation. Such requests should be sent to the following functional e-mail address:

24/11/2009 - US TSA RELEASES DRAFT RULE IMPOSING A SECURITYT PORGRAMME FOR ALL FAA REPAIR STATIONS
The US TSA (Transportation Security Administration) has published an official proposal of rulemaking that potentially will affect, not only US-based repair stations, but the 694 foreign repair stations located outside the United States that have an FAA certificate under part 145 of the FAA’s rules. The impact and expense of this rulemaking can be significant as it will require all FAA repair stations to adopt and implement a standard security programme and to comply with security directives issues by the TSA. 10/09/2009 - NEW UPDATE - EUROPEAN COMMISSION PUBLISHES AN UPDATED OPERATORS LIST FOR ETS
The European Commission published last month an updated list of operators included into the EU ETS. In accordance with the EBAA Fow Chart, we suggest you to:
- check if you are in the list (see list attached)
- check which is your administering member state
- check which is your competent authority (see list attached)
- get in touch with your competent authority if not already done

Deadline for the submission of the monitoring plans depends on the competent authority:
- UK: 11 weeks after 22 August (date of publication of the updated operators list)
- Germany: 6 weeks after 22 August
- Italy: 30 September
- Sweden: 15 October
- All the rest 23 Member States: 31 August 2009

24/08/2009 - JAR 26 ON ADDITIONAL AIRWORTHINESS REQUIREMENTS FOR OPERATIONS TO BE TRANSPOSED INTO THE EASA SYSTEM
EASA is currently circulating a questionnaire to be completed by aircraft operators on JAR 26. This questionnaire will help EASA transpose JAR 26 on Additional Airworthiness Requirement for Operations into the EASA rule system. The deadline for the questionnaire is 10 October.
Please find attached the questionnaire and related JAR 26 documents including an explanatory letter, the preamble, the requirements, the amendments and the AMC.

After a long battle, the German Business Aviation Association (GBAA), is proud to announce that Dr.Schaefer (GBAA Lawyer) has recently won a remarkable lawsuit: The Court has ruled that companies using an aircraft for business non-AOC flights eg corporate, have the right to reclaim any previously paid fuel tax and for the future, to enjoy tax free refuelling on production of a certificate to demonstrate business non-AOC usage.

As this can represent significant sums of money, we would recommend our Members operating such flights to check immediately if this might be applicable to them.

30/06/2009 - EUROCONTROL TO MANDATE TCAS UPGRADE BY END 2009
Eurocontrol has announced to EBAA that it will release a draft NPA by end 2009 requesting operators to upgrade their TCAS II to the TCAS II 7.1 version.
According to Eurocontrol most aircraft should already be fitted with 7.0 version and for most of them it will therefore be a relatively simple software upgrade. Eurocontrol believes that only aircraft fitted with TCAS Rockwell Collins TTR 7 20 will require a more complicated upgrade.
Eurocontrol expects to have the NPA approved by late 2010, with the retrofit becoming mandatory shortly after.

Please find attached a Proposal for a Directive of the European Parliament and the Council on Aviation Security Charges. The attached press release provides you with a summary of the main provisions of this legislative proposal.

Please note, for the adoption of this proposal into Community law, it must go through the co-decision legislative procedure where the European Parliament and the Council play key roles in the final content of the proposal. The timeframe for the adoption is between 20 to 25 months.

02/12/2008 - 2 DECEMBER 2008 - UK AIP PUBLISHES NEW REQUIREMENTS FOR TRANSPONDER USE ON GROUND
UK NATS has been made aware that with effect 12 Feb 2009 the UK AIP will harmonise on the use of A2000 squawk on ground as follows: "Unless otherwise instructed by ATC, Mode S transponder equipped aircraft on the aerodrome surface should select Mode A code 2000 when under tow; or parked and prior to selecting OFF or STDBY."
